The Brazilian rural land ownership regularization: an estimate

Abstract

This article aims to show that, based on existing legislation, the cost to regularize all Brazilian non titled property would be very high. The study was based on the non titled properties regularisation at the São José municipality in the State of Pará. The Land Institute of Pará (Iterpa) experience had extremely good legal results and very reasonable cost, even when compared with regularisation costs estimates from the experience of MDA, funded by the Inter-American Development Bank (IDB), in several Brazilian states. But when the costs of these experiences are generalised to all the properties and land in the country, you get to numbers that show it would be impossible to regularise all the land of the country. In this sense, this article proposes changes in legislation to make it viable and pointing in the direction of building a system of land administration in Brazil.
